Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Formvo, operated by MBJR Creative, LLC (“we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Formvo is a conversational form builder that uses AI to help you create forms, collect responses through natural conversations, and analyze results. The Service includes the web application at formvo.app, embeddable widgets, and related APIs.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date.

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

3. Plans & Pricing

Free Plan

The Free plan includes limited features as described on our pricing page. We reserve the right to modify Free plan limits at any time.

Plus Plan

The Plus plan is a monthly subscription billed at the rate displayed at checkout. Subscriptions renew automatically each month unless canceled.

Billing

Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You are responsible for keeping your payment method current.

Cancellation

You may cancel your Plus subscription at any time from your billing settings. Upon cancellation, you retain access to Plus features until the end of your current billing period. After that, your account reverts to the Free plan. Your data is preserved.

Refunds

Because the Service provides immediate access to features upon payment, refunds are generally not provided. If you believe you were charged in error, contact us at hello@formvo.app within 14 days of the charge and we will review your request.

Price Changes

We may change subscription pricing with at least 30 days’ notice. Price changes take effect at the start of your next billing cycle after the notice period.

4. Your Content

You retain ownership of all content you create or upload through the Service, including forms, conversation designs, and branding assets (“Your Content”).

You grant us a limited license to host, store, process, and display Your Content solely to provide the Service. This includes processing conversation data through our AI providers to generate responses and summaries.

You are responsible for Your Content and must ensure it does not violate any laws or third-party rights.

5. Respondent Data

When someone fills out one of your forms (“Respondent”), their responses are stored in your account. You are the data controller for Respondent data. You are responsible for:

  • Providing appropriate privacy notices to your Respondents
  • Obtaining any necessary consents for data collection
  • Handling Respondent data in accordance with applicable laws
  • Responding to Respondent data access or deletion requests

We act as a data processor on your behalf for Respondent data.

6. AI-Generated Content

The Service uses AI to generate conversation responses, summaries, and lead scores. AI-generated content is provided as-is and may not always be accurate. You should review AI outputs before relying on them for business decisions.

We do not use your form data or conversation data to train AI models.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Collect sensitive personal data (health, financial, SSN) without appropriate safeguards
  • Send spam, phishing, or deceptive content through forms
  • Distribute malware or malicious code
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to the Service or other users’ accounts
  • Interfere with or disrupt the Service’s infrastructure
  • Scrape, crawl, or harvest data from the Service
  • Use the Service to generate content that is illegal, harmful, or abusive

We reserve the right to suspend or terminate accounts that violate these terms.

8. API Access

API access is available on the Plus plan. You are responsible for securing your API tokens and for all actions taken through the API using your tokens. Rate limits and usage policies apply as documented.

9. Availability & Support

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

Support is available via email at hello@formvo.app. Plus plan subscribers receive priority support.

10. Intellectual Property

The Service, including its design, code, features, and branding, is owned by MBJR Creative, LLC. Nothing in these Terms grants you rights to our trademarks, logos, or other intellectual property beyond what is needed to use the Service.

11. Limitation of Liability

To the maximum extent permitted by law, MBJR Creative, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any AI-generated content or recommendations
  • Any third-party conduct on the Service

Our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

You may delete your account at any time by contacting us at hello@formvo.app. We may suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period following account deletion.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in St. Johns County, Florida.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
